The law relating to gas certificates is regulated and enforced by the UK Health and Safety executive.
Unquestionably the HSE see their prime role as being to enhance the safety of anyone using gas systems within commercial and domestic properties. It is the HSE who regulate for gas safety and it is they who will mount a prosecution where Landlords and others have not conformed to Gas Safety regulations.
From 1st. April 2009 Capita Plc have taken over from Corgi as the official body seeing to the registration of gas installers and the new body will be known simply as 'Gas Safe'
Landlords who fail to meet their obligations regarding gas safety are always prosecuted and the penalties available to the courts cover a very wide range. Peoples lives are at stake and the penalties imposed by courts can range from small to very large fines. Where a death has resulted or an offender has repeatedly flouted the regulations the courts have the power to impose lengthy custodial sentences.
